Most of the students who come to our office have this confusion with Arraigo and Modification procedure. Spanish Law have these two similar paths for students to become a legal residence.
If you are on your third year of studies, you may have a job offer or a business idea, in order to accomplish any of them you have to have residency status.
Immigration change status for student to residence in Spain after 3 years: Arraigo or Modification?
Three short questions:
- Are you going to have a certificated from the University that stated you finished the studies?
- Does your TIE expires after the 3 years required?
- Does your TIE expires three months before the 3 years required?
- Do you have a job offer or a business plan?
If you answer positively to these questions you can start thinking on modification. That means you won’t have to wait more than three months for the resolution (right now Madrid Immigration Office has a huge delay on Arraigo applications).
If you answer negatively to some of these questions, it is possible that you will have to access to the residence status by the arraigo procedure. That means that you will have to submit documents such us: Police background check, informe de arraigo and proofs of these last 3 years, before the day of the appointment at the immigration office.
There is another “but”, in these three years before the application for arraigo, you cannot be outside of Spain more than 120 days. Otherwise your application won’t be accepted.
